You understand and agree that we are not responsible for any data loss, service interruptions, or other issues resulting from the use of Apple's iCloud and CloudKit infrastructure.
While you retain ownership of your User Content, by posting it to the public or shared areas of the App, you grant us a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, and display your User Content in connection with operating and providing the App.
All rights, title, and interest in and to the App (excluding User Content), including all associated intellectual property rights, are and will remain our exclusive property. You may not copy, modify, distribute, sell, or lease any part of the App without our explicit written consent.
We may suspend or terminate your access to the App at any time, for any reason, and without prior notice, including if we reasonably believe you have violated these Terms. Upon termination, your right to use the App will immediately cease. You may also terminate this agreement at any time by deleting the App and removing its data from your iCloud settings.
The App is provided on an "AS IS" and "AS AVAILABLE" basis. We expressly disclaim all warranties of any kind, whether express or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the App will be secure, error-free, or continuously available.
To the fullest extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your access to or use of or inability to access or use the App; or (b) any conduct or content of any third party on the App.
These Terms shall be governed by and construed in accordance with applicable laws, without regard to its conflict of law principles. We reserve the right to modify these Terms at any time. If a revision is material, we will provide notice prior to any new terms taking effect. By continuing to access or use the App after those revisions become effective, you agree to be bound by the revised Terms.
